End User License Agreement (EULA)

1. Acknowledgement

This End User License Agreement ("Agreement") is a legal agreement between you ("End-User") and Furkan Hidayet Alkan ("Licensor", "we", "us", or "our"), the developer of PetNexa ("Licensed Application"), a mobile application designed to help pet owners track and manage their animals' health. This Agreement governs your use of the Licensed Application made available to you through the Apple App Store.

Both parties acknowledge that this Agreement is concluded between the Licensor and the End-User only, and not with Apple Inc. ("Apple"). The Licensor, not Apple, is solely responsible for the Licensed Application and its content. This Agreement may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions as of the date the End-User enters into this Agreement.

2. Scope of License

The Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

This license does not allow you to use the Licensed Application on any device that you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.

You may not rent, lease, lend, sell, redistribute, or sublicense the Licensed Application. You may not copy (except as expressly permitted by this license), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law).

3. Service Description

PetNexa is a mobile application and web platform that helps pet owners track their animals' health. Our services include:

• Creating and managing pet profiles
• Vaccine tracking and reminders
• Health record keeping
• Veterinary appointment management
• AI-powered health consultation (AI Veterinarian)

The AI Veterinarian feature is for informational purposes only and does not replace professional veterinary advice. You should always consult a licensed veterinarian for your pet's health concerns.

4. User Account and Eligibility

To use the Licensed Application, you must create an account. You must be at least 18 years old to create an account. You agree to provide accurate and up-to-date information during registration and to keep this information current. You are responsible for the security of your account and must immediately report any unauthorized use.

5. Data Collection and Privacy

The Licensed Application collects personal data including your name, email address, pet information (name, species, breed, health records), and device/usage information. This data is used to provide and improve our services, send reminders, operate the AI Veterinarian feature, and provide customer support.

Your data is protected using SSL/TLS encryption, encrypted data storage, regular security audits, and access control mechanisms. For complete details on data collection, use, and your rights, please refer to our Privacy Policy at https://www.petnexa.app/legal/privacy.

Under KVKK and GDPR, you have the right to access, rectify, delete, object to processing, and port your personal data. When you delete your account, your data will be permanently deleted within 30 days.

6. Third-Party Services

The Licensed Application utilizes third-party services including Google Play Services, AdMob, OneSignal, Expo, Sentry, and RevenueCat. These services have their own terms and privacy policies. The Licensor is not responsible for the practices of these third-party services.

7. Use of Artificial Intelligence

The Licensed Application incorporates Artificial Intelligence (AI) technologies to provide certain features, including the AI Veterinarian. By using the Licensed Application, you acknowledge and agree that AI may be used to process data and deliver functionalities.

8. Maintenance and Support

The Licensor is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this Agreement or as required under applicable law. Both parties acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

9. Warranty

The Licensed Application is provided on an "AS IS" and "AS AVAILABLE" basis. The Licensor does not warrant that the Licensed Application will be uninterrupted, error-free, or free of harmful components. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.

10. Product Claims

Both the Licensor and the End-User acknowledge that the Licensor, not Apple, is responsible for addressing any claims relating to the Licensed Application, including but not limited to:

• Product liability claims
• Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
• Claims arising under consumer protection, privacy, or similar legislation

11. Intellectual Property Rights

All trademarks, copyrights, database rights, and other intellectual property rights related to the Licensed Application remain the sole property of the Licensor. Unauthorized copying, modification, or distribution of the Licensed Application is strictly prohibited.

Both parties acknowledge that, in the event of any third-party claim that the Licensed Application infringes that third party's intellectual property rights, the Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Misunderstanding of AI Veterinarian recommendations
• Missed appointments due to not receiving reminders
• Technical failures or data loss
• Any loss arising from reliance on the Licensed Application's functionality

13. Usage Rules

When using the Licensed Application, you agree to:

• Act in accordance with applicable laws
• Respect the rights of other users
• Not share misleading or false information
• Not misuse the system or attempt to harm other users
• Not jailbreak or root the device on which the Licensed Application is installed
• Accept responsibility for the accuracy of your pet's health information

14. Termination

This license is effective until terminated by you or the Licensor. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. You may terminate your account at any time. Upon termination, you must cease all use of the Licensed Application and delete it from your device.

15. Internet Connectivity

Some functions of the Licensed Application require an active internet connection. The Licensor is not responsible if the Licensed Application does not function at full capacity due to lack of internet access. You accept responsibility for any charges from your mobile network provider related to use of the Licensed Application, including roaming data charges.

16. Apple as Third-Party Beneficiary

Both parties acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon the End-User's acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against the End-User as a third-party beneficiary thereof.

17. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey. Istanbul Courts shall have exclusive jurisdiction in any disputes arising from this Agreement.
